The following Terms & Conditions (here within referred to as "terms") are intended to let you know of your legal rights and responsibilities in using Third Wheel's website www.thirdwheel.com.np (here within referred to as "website") and any other related mobile applications (here within referred to as "app").
"Customer", "User", "Client", "You" or "Your" refers to you, who avails the services of Third Wheel through its app to repair your vehicle including but not limited to general servicing, repairs, punctures, emergency breakdowns.
"Third Wheel", "Us" or "Company" shall mean Third Wheel Pvt. Ltd. Kathmandu, Nepal. Which expression shall, unless it is repugnant to the context or meaning thereof, mean and include all its affiliates, successors, and permitted assigns?
"Service(s)" shall mean any and all kinds of vehicle repair services listed and provided through the app including but not limited to motorbike services and also the information provided by us on the app regarding the various service.
"Vehicle" refers to motorbikes, Scooters, and Mopeds with a valid registration ID, registered under the Motor Vehicles & Transport Management.
"Account" shall mean the account created by/for the customer on the app to avail of the services.
"Order" shall mean the request for a service placed by the customer through the app on a particular date.
"Service Executive", "Executive", "Ground Staff" shall mean the person from Third Wheel, that will be assigned to the particular order to carry out the particular order from picking up of the vehicle until the delivery of the vehicle.
You hereby confirm that you are at least 18 years of age and above and fully able and competent to understand the terms of this agreement.
You should have a valid vehicle registration ID along with a valid Driving License (optional) to avail of our services. The customers without any one of the formerly listed documents are not eligible to book our services.

For requesting emergency service, the User must have previously taken at least one service before with us.
Third Wheel account users must email us regarding the closing account.
Third Wheel provides you with the convenience of getting your vehicle serviced without any expense of your time.
The customer upon creation of the account will be provided with a user panel to place the order for services. The customer should enter the location of pickup of the vehicle and should select the type of service from the listed services on the app. Upon the selection of the required service, the customer should choose the vehicle type, date, the service center, and the time slot of service and place the order.
Our service executive will be available at the location you have provided in the time slot you have requested for the bike pickup. In the case of emergency breakdowns, Third Wheel may appoint an authorized transportation partner to transport your vehicle to the service center of your choosing or the nearest service center from the pickup location. You should be available for a call half an hour before the start time of the booked time slot. You should be ready with the following documents at the time of pickup: Vehicle registration certificate, valid Driving License. A thorough check-up of the bike including but not limited to a test ride will be done at your place. You will be updated on a real-time basis regarding the status of your vehicle through messaging. You can also check the status of your vehicle in the user panel provided to you on the app.
Once the Service executive takes your bike to the service center, you will be updated via call or messaging or on the app regarding the estimated pricing for that particular servicing and all the repairs that will be done in that estimated pricing. Upon your approval on the estimated pricing, our service executive will be giving a go-ahead for the service at our own service center.
You are solely responsible for maintaining the confidentiality of your account details and will be liable for all activities and transactions that take place under your account, whether initiated by you or any third party. We shall not be liable for the loss of any information or such by a third party accessing your account with or without your knowledge.
Third Wheel holds the responsibility for the quality of the service provided by its service center.
Third Wheel has its own fully equipped service center at Lokanthali, Bhaktapur with skilled and experienced service mechanics.
Price Estimations for general servicing: Upon the booking of an order on the app and before the confirmation of the order, you will be shown a basic amount as an estimate for that particular servicing. This pricing information is presented to you only after confirmation. However, this amount is subjected to change. Once our service executive takes your bike to our service center, a proper estimate of the pricing will be provided to you. Your order will be processed only after your approval for the estimated pricing and the repairs under that pricing.
Price Estimations for the rest of the services (Including but not limited to repairs, replacements, accidental emergency breakdowns): Upon the confirmation of an order on our website or the app, your order will be booked with a zero charge or a minimal charge. This means that the price estimate of that particular service(s) will be provided to you once our service executive takes your bike to our service center. Your order will be processed only after your approval for the estimated pricing and the repairs under that pricing.
You will be charged a nominal fee from Third Wheel. This fee will be reflected in the final invoice provided by Third Wheel. The fee can be viewed at the time of placement of the order. However, it's only an estimated calculation. The actual fees would be calculated depending on the condition of your bike. Third Wheel takes the liberty to charge the fees as per its effort to get your order processing done.
As soon as your vehicle is ready for delivery after the repairs, our service executive will intimate you via call or messaging the total payment to be done for that particular order. A service fee will be messaged to you before the delivery of the bike. You are expected to make the payment against that Performa Invoice on the delivery of the bike via the following payment methods:
Cash Payment: The payment for the order can be made via cash on delivery to our service executive at the time of delivery of the bike. Payment more than NPR 4000/- Need to pay all in advance expect 4000 of bill amount before delivery of bike or scooter.
Online Payment: You have the flexibility to make the payment online against the provided Performa invoice either through E-Sewa, Khalti, IME Pay, FonePay or Online Bank Transfer. You are expected to make the payment once your vehicle has been delivered to you. Third Whee is not liable to any transactional loss during fund transfer from the customer to THird Wheel account until the amount is deposited on third wheel merchant/bank accounts.
Third Wheel will generate an invoice post payment on the app itself so you can save it for future reference.
Cancellation and Rescheduling Policy: The order once placed can be canceled but when it went in the process you can’t cancel the service order. In case of emergency breakdown cancellation of the service is not available. The order once placed can be rescheduled to a different date and time slot according to your convenience. If Third Wheel, in any case, has any reason to believe that the customer has violated the terms of the service listed in this document, Third Wheel reserves the sole right to cancel the customer’s order without any prior notice to the customer.
Force Majeure: We shall not be liable for any failure to perform any obligations under this User Terms if the performance is prevented, hindered, or delayed by a Force Majeure Event, and in such case, our obligations under this User Terms shall be suspended for so long as the Force Majeure Event continues.
Indemnification: By accepting these User Terms and using the Service, You agree that You shall defend, indemnify and hold Third Wheel and each of their officers, directors, other users, employees, attorneys, and agents harmless from and against any claims, costs, damages, losses, liabilities, and expenses arising out of or in connection with:
(a) Your violation or breach of any term of these User Terms or any Applicable Law or regulation, whether or not referenced herein;
(b) Your violation of any rights of any of our vendors
(c) Your use or misuse of the Application or Service.
Intellectual Property Ownership: The page, page code, and any copyrights, trademarks, service marks, trade names, and all other intellectual property or material or property rights here are proprietary to the Company and are owned by the Company and/or its licensors and content providers, and are protected by applicable domestic and international intellectual property laws. The depiction of such proprietary content does not permit or allow any user or person (whatsoever) to make any use of the same without prior written permission of the Company in any manner or reference or context.
Modifications of the Service and Terms: Third Wheel reserves the right, at its sole discretion, to modify or replace any of these User Terms, or change, suspend, discontinue or restrict your use to all or any feature of the Service or Application at any time by sending You to notice on your registered mobile number and email ID.
Applicable Law and Dispute Resolution: These User Terms are subject to the laws of Nepal. Any dispute, claim or controversy arising out of or relating to these User Terms or the breach, termination, enforcement, interpretation, or validity thereof or the use of the Service or the Application will be subject to the exclusive jurisdiction of the court.
Home service means we do the service at your home or office. Condition of bike and scooter must be elaborate by the customer for parts needed. We don't do bike wash for home service.
For the dent paint service, all the service prices should pay in advance. Also, the price list shown in our mobile application is not an exact price it may change after observation of particular parts of your vehicle.
We introduce reward points for the third wheel users. Since this is totally new concept for us to introduce rewards to our users, we may change our service charge points. Once we finalize, we will fix that point for purchase goods or services from the third wheel.
We introduce the sell and buy of your bike or scooter as a platform, on which you can list your bike and people will buy from your listing. We were nowhere involved in the process. Buyer and seller can fix selling or buying of their two-wheelers. We don't provide any claim on the bike or scooter bought from our app.
50 Rupees deducted as cancellation charge for emergency service.
